Defense Wants Murder Charge Dismissed

PASCO, Wash. - Attorneys defending a woman accused of murdering her mother want the judge to dismiss charges.

Lawyers for Tashia Stuart say they won't be ready for the February trial because they say prosecutors have dragged their feet in getting evidence to them.

The attorneys argue delaying the trial would violate Stuart's right to a speedy trial.

Franklin County Prosecutor Shawn Sant says evidence from the state crime lab will be available in early January.

The judge will hear arguments next month on the defense motion.

Sant says he is also adding a second count of conspiracy after the defense didn't accept a plea offer.

The conspiracy count is based on an alleged scheme to kill Judy Hebert a month before her shooting death in March 2011.

Stuart claims she shot her adoptive mother in self defense.
