KENNEWICK, Wash. - It could be round two for a former Kennewick fitness club owner accused of theft.
Jason Sleater was back in court Thursday morning, where a judge set a pretrial date for November 8th.
On that day, prosecutors will announce if they plan to retry Sleater on theft charges.
Prosecutors say Sleater charged the members at 509 Fitness a $20 gym enhancement fee, and then closed the gym without giving refunds.
But last week, a jury acquitted Sleater on two theft charges, and the judge declared a mistrial on six others.
