YAKIMA, Wash.-- A Yakima County judge could dismiss charges on a man accused of killing three people in West Valley last year.
Kevin Harper faces murder charges for the deaths William, Pauline, and Elizabeth Goggins. His attorney called for a dismissal of the case, saying Harper's right to a speedy trial was violated. He says the prosecutor did not share evidence with the defense quickly enough. The judge agreed sanctioning the prosecutor for a thousand dollars. She also set benchmarks on when both sides need to share information.
"That is somewhat unusual... To go to that length to manage a case, but she is concerned that this case has languished too long and she wants to move it forward," says Court Consultant Harold Delia.
The judge will make her decision on dismissing the charges by September 17th. If she decides to continue the case, the trial will start some time in November.
