YAKIMA, Wash.-- The man who turned himself in to police this weekend after a shooting at a Safeway in Yakima was scheduled to be released from jail Wednesday.
Anastacio Lepe, 37, is suspected of shooting Jaime Partida, 25, several times during an argument over a cell phone.
But Wednesday, Lepe's attorney says it was all in self defense.
"Mr. Lepe arrived to buy his stolen telephone back. The person began to grab for something that appeared to be a gun," said his attorney, John Crowley.
Crowley says Lepe was afraid for his family, that's why he didn't wait for police.
Right now, no charges are being filed against Lepe, but police are still investigating the circumstances and that could change.
